Terms of Service

The agreement

These terms are between you and Will Sutherland ("we", "us"), the independent developer of the Mind Terrarium mobile app and this website, which are published under the name Chilly Dawg Studios. By installing or using the app you accept them. If you do not accept them, please don't use the app.

You need to be at least 18 years old to use Mind Terrarium. The app is built on a generative AI service, and Google's terms for that service require an adult user, not a minor with or without a parent's permission — so this isn't optional the way a typical app's age minimum is. If you're under 18, please don't use the app.

Not medical care

The app is a personal journal with a decorative game attached. It is not a medical device, and nothing in it is medical or mental-health advice, diagnosis or treatment. The reflections it writes are not clinical assessments and must not be used as a substitute for care from a qualified professional. Decisions about your health are between you and a real clinician.

Your licence to use the app

We give you a personal, non-exclusive, non-transferable, revocable licence to install and use Mind Terrarium on devices you own or control, for your own non-commercial use. We keep everything else: the app, its code, its artwork, the species and their names and descriptions, and the Mind Terrarium name and logo all remain ours.

You agree not to:

• copy, sell, rent or redistribute the app;
• reverse-engineer, decompile or modify it, except where the law says you may;
• strip out or work around App Check or any other integrity mechanism;
• use the app's connection to Google's AI service for anything other than your own journal entries, including automated or bulk requests.

Your entries are yours

You retain whatever rights you have in your journal entries, photos and voice recordings. We claim no ownership of them and no licence to use them. We do not hold a copy: your journal is stored on your device, as described in the Privacy Policy.

Because it lives only on your device, keeping it safe is up to you. Uninstalling the app, losing the device, or resetting the app's data will destroy your journal, and we have no way to bring it back.

What the AI writes

Reflections, transcripts and recaps are produced by a Google Gemini model, and generated text can be wrong. A transcript may mishear you. A summary may emphasise the wrong thing or state something you didn't mean. Read it as a mirror that is sometimes smudged, not as a record of fact, and don't rely on it for anything consequential.

The service depends on Google's availability and on your internet connection, and reflections may occasionally fail, be delayed, or come back empty. When that happens the entry itself may be lost. A failed voice recording may stay on your device so you can retry without recording it again, but that isn't guaranteed. Buying the Terrarium Pass unlocks features, not a guarantee that any given request will succeed.

Stardust, wisps and species

Stardust, wisps, plants and creatures are decorative items inside the app. They have no monetary value, cannot be exchanged for money or anything outside the app, and are not property. They exist only in your installation of the app and disappear with it.

We may adjust prices, payouts, drop rates, caps and the roster of species at any time as the game is balanced. Doing so is not a taking of anything you own.

Subscriptions and payment

The Terrarium Pass is an auto-renewing subscription, billed monthly or yearly at the price shown on the purchase screen in your local currency. It's sold and billed by the app store you downloaded from — Apple or Google — not by us, and we never see your payment details.

A free trial, where offered, converts automatically into a paid subscription unless you cancel before it ends. Your subscription renews automatically until you cancel it, and keeps working through the period you've already paid for even after you cancel.

Manage, cancel or check pricing for your subscription through your Apple or Google account settings, or from the subscription management option inside the app. Refunds and billing disputes are handled by the store you bought through, under its own policy — we can't issue refunds directly.

Because Mind Terrarium has no accounts, a subscription belongs to the Apple or Google account that bought it. Restoring it on a new device or after reinstalling means signing into that same store account; we can't transfer a subscription between stores or move it another way.

We may change subscription prices going forward. A price change won't affect your current billing period, but can apply starting at your next renewal; the app store will notify you before a renewal happens at a higher price, and you can cancel before then if you don't want it.

Acceptable use

Use the app for your own reflection. Don't use it to break the law, to harass anyone, to store material you have no right to hold, or to attempt to disrupt, overload or gain unauthorised access to any system the app connects to.

Availability and changes

We may change, suspend or discontinue any part of Mind Terrarium, including individual features, at any time. We may also stop distributing or supporting the app entirely. Where we can reasonably give notice of something that would destroy data on your device, we will.

We may update these terms. Material changes will be posted here with a new date, and continuing to use the app after that means you accept the updated terms.

Disclaimer

To the fullest extent permitted by law, Mind Terrarium is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any reflection it produces will be accurate or useful.

Some jurisdictions do not allow the exclusion of certain warranties, so parts of this may not apply to you.

Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, journal content, goodwill or profits, arising out of your use of or inability to use Mind Terrarium — including loss of entries stored on your device.

Where liability cannot be excluded, our total liability to you for all claims is limited to the greater of the amount you paid us for the app in the twelve months before the claim, or ten US dollars.

Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.

Indemnification

You agree to cover us for any claim, loss or expense (including reasonable legal fees) arising from your misuse of the app, your breach of these terms, or content you store that you have no right to hold.

Ending this agreement

You can end it at any time by uninstalling the app. We may suspend or end your licence if you materially breach these terms. The sections on ownership, disclaimers, limitation of liability, indemnification and governing law survive.

Governing law

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules. The courts of Alberta have exclusive jurisdiction over any dispute — except that if you are a consumer somewhere whose law gives you the right to bring a claim locally, that right is unaffected.

Severability

If any part of these terms is found unenforceable, the rest continues to apply. The unenforceable part will be read to reflect its original intent as closely as the law allows.

Assignment

We may transfer or assign this agreement, in whole or in part, at any time, including as part of a sale, merger or transfer of the app. You may not assign your rights under this agreement to anyone else.

Force majeure

We aren't responsible for delays or failures caused by things reasonably outside our control, including outages of Google's services, internet or app store disruptions, or other events we couldn't reasonably plan around.
